1. About us
This website is operated by Plants Etc, a small business based in the Scottish Highlands.
Throughout these Terms and Conditions, “Plants Etc”, “we”, “us”, and “our” refer to Plants Etc.
If you have any questions about these Terms and Conditions, please contact: Fiona MacKenzie at fiona@plantsetc.co.uk
2. Use of this website
This website is provided for general information about our products and services, including flowers, plants, workshops, gift vouchers, and delivery options.
You agree to use this website only for lawful purposes and in a way that does not infringe the rights of, or restrict the use of this website by, others.
You must not:
- use this website for fraudulent or unlawful purposes
- attempt to gain unauthorised access to the website or its systems
- introduce viruses, malware, or harmful code
- copy or reproduce website content without permission.
3. Website information
We make every effort to ensure the information on this website is accurate and up to date. However:
- product descriptions, photographs, and prices are provided for general guidance only
- availability may change without notice
- colours may appear differently on different screens
- seasonal flowers and plants naturally vary in appearance.
We reserve the right to update or remove information from the website at any time.
4. Orders and enquiries
Our website is a brochure and enquiry platform. Orders are not completed directly through the website.
Submitting an enquiry does not create a binding contract.
A contract is formed only when we confirm your order details, availability, and price directly with you.
We reserve the right to decline any order request.
5. Pricing and availability
All prices shown on the website are in pounds sterling (£) unless otherwise stated.
Prices and availability are subject to change without notice.
Delivery charges, where applicable, will be confirmed when your order is agreed.
6. Flowers and plants
Flowers and plants are natural products and may vary in:
- colour
- shape
- size
- stem count
- flowering stage
Where a specific variety or flower is unavailable, we may substitute with a similar item of equal or greater value.
Care instructions are provided as general guidance only, as growing conditions vary.
7. Deliveries and collections
Delivery and collection arrangements will be agreed directly with you.
Please ensure that delivery details are accurate.
We are not responsible for delays caused by incorrect information, adverse weather, road conditions, or circumstances beyond our reasonable control.
Risk in goods passes to you upon delivery or collection.
8. Workshops
Workshop places are subject to availability.
Bookings are confirmed once payment has been received, if applicable.
If you are unable to attend, please contact us as soon as possible. Refunds or transfers are offered at our discretion unless otherwise stated at the time of booking.
We reserve the right to cancel or reschedule workshops if necessary. In this case, you will be offered an alternative date or a full refund.
Participants are responsible for informing us of any relevant allergies or accessibility requirements.
9. Gift vouchers
Gift vouchers are valid for 12 months from the date of issue unless otherwise stated.
Gift vouchers:
- are non-refundable
- cannot be exchanged for cash
- must be used before the expiry date
Lost or misplaced gift vouchers may only be replaced where proof of purchase is provided and the voucher has not already been redeemed.
10. Cancellations and refunds
Your statutory rights under UK consumer law are not affected.
Because flowers and many plants are perishable items, they are generally exempt from the 14-day cancellation right under the Consumer Contracts Regulations.
If there is a problem with your order, please contact us as soon as possible and, where appropriate, provide photographs.
Refunds or replacements will be offered where goods are faulty, damaged, or not as described.
For non-perishable goods and workshop bookings, any cancellation terms will be communicated when your order or booking is confirmed.
11. Intellectual property
All content on this website, including text, photographs, graphics, and logos, is the property of Plants Etc unless otherwise stated.
You may not copy, reproduce, distribute, or use any content without prior written permission.
12. User submissions
If you submit reviews, testimonials, photographs, or other content to us, you grant us permission to use that content for marketing and promotional purposes unless you request otherwise.
13. Third-party links
This website may contain links to third-party websites.
We are not responsible for the content, policies, or practices of those websites.
14. Limitation of liability
To the fullest extent permitted by law, Plants Etc shall not be liable for any indirect or consequential loss arising from your use of this website or from any products or services supplied by us.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence or for fraud.
15. Privacy
